1. Agreement to terms
By creating an account, clicking “I agree,” or using Buckwheat (“the Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Buckwheat (“we,” “us,” “our”).
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Eligibility
You must be at least 18 years old to use Buckwheat. By creating an account, you represent and warrant that you are at least 18 years of age. We do not knowingly provide the Service to anyone under 18.
3. Your account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must not share your account or credentials with others. Notify us immediately if you suspect unauthorised access.
We authenticate via Google OAuth. You are responsible for the security of your Google account.
4. What Buckwheat provides
Buckwheat is a personal AI companion that provides conversational AI, document analysis, adaptive memory, and multi-channel access. The Service routes your queries to third-party AI model providers based on your selection.
Buckwheat is not an AI model provider. We do not build, train, or fine-tune AI models. We orchestrate access to models provided by third parties (including OpenAI, Anthropic, Google, xAI, DeepSeek, Groq, and Perplexity).
5. AI outputs and limitations
AI outputs may be inaccurate, incomplete, or misleading. Due to the probabilistic nature of AI models, responses may not accurately reflect real people, places, facts, or events. You are responsible for evaluating and verifying all outputs before relying on them.
Buckwheat is not a substitute for professional advice. Do not rely on outputs as medical, legal, financial, tax, or other professional advice. Always consult a qualified professional for decisions that could affect your health, legal rights, or finances.
Buckwheat’s memory system automatically extracts facts from your conversations to personalise your experience. These extracted facts may be incorrect or misattributed. You are responsible for reviewing and correcting your stored profile through the Brain Panel.
6. Acceptable use
You agree not to use the Service to:
- Violate any applicable law, regulation, or the rights of others
- Generate, distribute, or store child sexual abuse material or any content exploiting minors
- Harass, threaten, defame, or discriminate against any person
- Generate malware, phishing content, or tools for cyberattacks
- Impersonate others or misrepresent AI-generated content as human-authored where disclosure is required
- Attempt to reverse-engineer, extract weights from, or reproduce any AI model accessed through the Service
- Use outputs to develop competing AI products or services
- Circumvent rate limits, credit systems, or access controls
- Upload content you do not have the right to use
- Transmit viruses or malicious code
The Service routes queries to third-party AI providers. You are also bound by the acceptable use policies of the model provider you select.
7. Content ownership
Your content
You retain all rights to the content you submit to Buckwheat, including conversations, uploaded documents, and feedback. By using the Service, you grant us a limited, non-exclusive licence to process, store, and transmit your content solely to operate and provide the Service to you.
AI outputs
Subject to your compliance with these Terms, we assign to you all of our right, title, and interest — if any — in the outputs generated for you. AI-generated content may not be eligible for copyright protection in all jurisdictions. Outputs are not guaranteed to be unique — other users may receive similar outputs from the same underlying models.
No training on your data
We do not use your conversations, documents, memory data, or any other content to train or fine-tune any AI model. We may use your feedback (such as thumbs-up or thumbs-down ratings) to improve your individual Buckwheat experience through prompt optimisation, but never to train a shared model that serves other users.
8. Document uploads and knowledge base
You may upload documents, web pages, audio, and video to your personal knowledge base. You represent and warrant that you have all necessary rights to upload and process this content. Uploading copyrighted material without authorisation is a violation of these Terms.
Uploaded content is processed by third-party services (including AI model providers and embedding services) as described in our Privacy Policy.
9. Messaging channels
If you connect WhatsApp, Telegram, or other messaging platforms, you grant Buckwheat permission to receive, process, and store messages sent through those channels for the purpose of providing the Service.
You are responsible for informing any third parties who communicate with you through these channels that their messages may be processed by AI systems.
10. Smart home integrations
If you connect smart home devices, Buckwheat will execute commands on your behalf through third-party APIs (Google Home, TP-Link). You are solely responsible for any actions taken on your devices. Buckwheat is not liable for any damage, injury, or loss resulting from smart home commands, whether initiated correctly or in error.
11. Subscriptions, credits, and billing
Subscription plans
Buckwheat offers Free, Pro, and Power subscription tiers. Paid subscriptions are billed in advance on a recurring monthly basis. All payments are processed by Stripe.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. Payments are non-refundable except where required by applicable law. If you are in the EU, UK, or Turkey, you may be entitled to a full refund if you cancel within 14 days of purchase under statutory cooling-off rights.
Credits
AI usage is measured in credits. Each subscription tier includes a credit allocation. Additional credits may be purchased as bundles.
- Daily free-tier credits reset each day and do not accumulate
- Monthly subscription credits reset each billing cycle and do not roll over
- Purchased credit bundles do not expire but are non-refundable
- Credits have no cash value and are non-transferable
- Credits consumed during service outages or errors are not refunded unless the outage exceeds 24 continuous hours
Price changes
We may change our prices with 30 days’ advance notice. Continued use of a paid plan after the price change takes effect constitutes acceptance of the new price. You may cancel before the change takes effect.
12. Service availability
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or secure access to the Service. We may modify, suspend, or discontinue any part of the Service at any time.
Buckwheat relies on third-party AI model providers. We are not liable for outages, errors, or changes in behaviour of upstream models.
13. Limitation of liability
To the maximum extent permitted by law, Buckwheat shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to your use of the Service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Buckwheat, its affiliates, and its personnel from any costs, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your content infringing third-party rights; or (c) your misuse of the Service or its outputs.
15. Termination
You may stop using the Service at any time. We may suspend or terminate your access immediately and without notice if we believe you have violated these Terms or if required by law.
If we discontinue the Service entirely, we will provide at least 30 days’ notice and offer a pro-rata refund of any prepaid subscription fees for the unused period.
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow you to request an export, after which it will be deleted in accordance with our Privacy Policy.
16. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by Buckwheat and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose.
You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer or attempt to extract the source code.
17. Dispute resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any dispute arising under these Terms shall be resolved by binding individual arbitration, except that either party may bring claims in small claims court if they qualify. You waive the right to participate in class actions or class-wide arbitration.
You may opt out of the arbitration provision by notifying us in writing within 30 days of creating your account.
If you are in the European Union, United Kingdom, or Switzerland, mandatory arbitration and class action waivers may not apply to you under local law. You retain the right to bring claims before your local courts and to file complaints with your local consumer protection authority.
18. Changes to these Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days’ advance notice via email. If you disagree with the updated Terms, you may cancel your account before they take effect. Continued use of the Service after the effective date constitutes acceptance.
19. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any right or provision does not constitute a waiver.
- These Terms, together with the Privacy Policy, constitute the entire agreement between you and Buckwheat.
- You may not assign or transfer these Terms without our consent. We may assign our rights without restriction.
